The purpose of mitigation is to find facts or circumstances that lessen the defendant's culpability or severity of a criminal offense. It is used to help prepare a defendant for sentencing by reducing the effects of aggravating factors.
Mitigation is important because it can help reduce sentencing time by conducting interviews with the client, family members, and friends. Understanding the client's past can provide insight for the court to see the client's life.
Mitigating Factors include abuse, substance abuse, trauma, neglect, and mental health issues. Additional factors include lack of/extensive criminal history, family support, or lack of and poverty. All of these factors can be used to support arguments on the mitigation report that the court considers before reaching a verdict.
Mitigation can be acquired privately, or the attorney can request a mitigation specialist through the county Office of Contract Counsel. The report is made for the client and the court, it is not for family viewing.
